Penal provisions from Election Law should be moved to Criminal Code

Podgorica, (MINA) – The penal provisions regarding violations of electoral rights should be removed from the Law on Election of Councilors and MPs and introduced through amendments to the Criminal Code.

This is one of the recommendations of the State Election Commission (DIK) presented to the Committee for Further Reform of Election Law and Other Legislation.

The DIK has proposed that Article 30 of the Law on Election of Councilors and MPs should clarify the term of DIK’s President and prescribe that the president should have a deputy.

Pobjeda reports that the DIK has also suggested that DIK member from the civil society, NGO sector and the academic community should have a deputy.

“Article 33 of the Law prescribes that the DIK shall take over the competences of a municipal election committee in case it fails to fulfil its responsibilities in relation to the appointment of MPs. However, the Law does not regulate the procedure where a municipal election committee is not appointed or when it fails to fulfil its legal duties associated with the election of councilors,” the DIK said in its recommendations.
