Draft fiscalization law to be withdrawn

Podgorica, (MINA-BUSINESS) – According to Montenegro Business Alliance (MBA), a draft law on fiscalization in the trade in products and services should be withdrawn from the procedure, as the proposed provisions imposed additional costs to entrepreneurs and are too expensive for the Tax Administration.

The Alliance says that the general comments submitted during the public consultations are related to the normative, technical, comparative, legal and taxation aspects of the proposed piece of legislation, as well as to the economic segments, business barriers, liquidation of the fixed assets, inadequate reliance on comparative experiences, cash registers’ records, and consequences on the employment.

“In short, the proposed legislation is expensive for the business sector, as well as for the Tax Administration,” the press release says.

MBA says that the general conclusion of the business sector is that the proposed law would introduce a new business barrier, primarily in terms of additional costs for the entrepreneurs.

“We are particularly concerned about the comment that it is unclear how the proposed provisions would help combat the informal economy, given that all those who have been outside of the system so far will remain out of the reach of the Tax Administration,” MBA says.

On the basis of its analysis and consultations with its members, MBA proposed that the draft law on fiscalization in the trade in products and services should be withdrawn, and replaced with the activities aimed at expanding the taxpayers’ base.
