MJU: Capital City Assembly to elect new chair within 30 days

Podgorica, (MINA) - The Capital City Assembly is required to elect a new local parliament chair within 30 days after the termination of term of office of the previous chair, the Ministry of Public Administration (MJU) announced, adding that the law provides mesures in case the assembly fails to exercise its authority for more than six months.
Responding to media inquiries regarding the situation in the Capital City Assembly, following the resignation of the local parliament chair Jelena Borovinic Bojovic, the Ministry pointed out the relevant provisions of the Law on Local Government which regulate such situations.
They noted that the Capital City Assembly is obliged to elect a new Assembly chair within 30 days, while the law envisages mechanisms to ensure smooth functioning and continuity of the Assembly’s work in the period until the election.
According to the press release, although the law does not prescribe an immediate sanction in case the Assembly chair is not elected within 30 days, the election is one of the basic legal obligations of every municipal assembly.
The Ministry recalls that the Law on Local Government stipulates that the Government will warn a municipal assembly in case it fails to hold sessions for more than six months, does not execute the decisions of the competent courts or does not fulfill obligations established by law, which prevents the realization of citizens’ rights or causes significant material damage.
