Dismissal proceedings against President of Appellate Court suspended due to end of judicial office

Podgorica, (MINA) – The Supreme Court, ruling on the appeal filed by the defense attorney of Mirjana Popovic, suspended ex officio the proceedings concerning her dismissal as President of the Court of Appeal, because her judicial function had already ended.
The Supreme Court announced that the proceedings were conducted in connection with the appeal of Popovic’s defense attorney, filed against the decision of the Judicial Council from April 9 this year, which dismissed Popovic as President of the Court of Appeal over inappropriate treatment of court employees.
The Supreme Court found that, in accordance with the Law on the Judicial Council and Judges, the term of office of a court president automatically ends with their judicial office, which is why Popovic’s mandate as President of the Court of Appeal along with her judicial office.
“As Popovic had previously ceased to be a judge, the Supreme Court found that the termination of the judicial office is a circumstance that permanently precludes the further conduct of the dismissal procedure, which is why the procedure has been suspended”, the press release said.
