Becirovic and Mijatovic’s appeal upheld, oral custody extension unconstitutional

 

Podgorica, (MINA) - The Constitutional Court accepted the constitutional appeal of Zoran Becirovic and Mladen Mijatovic, whose detention has been extended by the Podgorica Basic Court, following the ruling on the attack on journalist Ana Raickovic.

According to the press release from the Constitutional Court, Becirovic and Mijatovic spent 32 days in custody without receiving a written decision against which they could appeal.

“A public announcement of the decision to extend their custody after the delivery of the verdict, without handing over a written decision for more than 30 days, is against the Constitution”, the press release states.

The Constitutional Court said that the Podgorica Basic Court clarified that the decision to extend detention was pronounced at the same time as the conviction, in a full courtroom before numerous citizens.

The press release adds that the Constitutional Court rejected the appeals of Becirovic and Mijatovic in the part where they claimed that there was no reasonable suspicion and no special circumstances for the extension of custody.
