HRA submits initiative for constitutionality review of ANB Law

 

Podgorica, (MINA) – The Human Rights Action (HRA) submitted on Friday an initiative to the Constitutional Court for the review of the constitutionality of four articles of the Law on the National Security Agency (ANB), which entered into force on March 23, claiming that the law violates the right to privacy.

 

The HRA stated that they submitted an initiative for the evaluation of the constitutionality of the provisions of articles 13, 18, 20 and 21 of that law.

 

“The initiative challenges the compatibility of the aforementioned provisions with the Constitution and verified international treaties on human rights protection”, HRA said.

 

They added that the disputed provisions share the same key flaw – they enable violation on citizens’ privacy without prior judicial oversight and without effective independent protective mechanisms.

 

The HRA pointed out that the disputed provisions are not in accordance with Articles 40 and 42 of the Constitution, as well as with Article 8 of the European Convention on Human Rights and Article 17 of the International Covenant on Civil and Political Rights.

 

The HRA recalls that the Agency for the Prevention of Corruption (ASK) has recently also criticized Article 21 of this law.
