Constitutional Court: No legal obstacles for extradition of US national

Podgorica, (MINA) – The Constitutional Court of Montenegro has rejected as unfounded the constitutional appeal filed by U.S. citizen R.H.W. assessing that there are no obstacles for his extradition to this country.
The Constitutional Court assessed that the Appellate Court issued constitutionally acceptable and sufficiently explained reasons based on the European Convention on Extradition, the Law on International Legal Assistance in Criminal Matters and the relevant practice of the European Court of Human Rights.
The Constitutional Court recalls that the Montenegrin courts approved the extradition of R.H.W. for the purpose of conducting criminal proceedings for two counts of criminal offense of conspiracy to commit a crime, while refused extradition for two counts of criminal offense of aggravated murder for financial gain, considering that the U.S. legal system prescribes penalties for these offenses that could be inconsistent with the human rights standards protection established by the European Convention on Human Rights.
According to the press release, the Constitutional Court did not accept as constitutionally justified the constitutional appeal claims that in case of extradition the accused would be exposed to the risk of being sentenced to death or life imprisonment without the possibility of parole.
