Zirojevic: EA to request constitutionality review of Law on Internal Affairs

Podgorica, (MINA) - The European Alliance (EA) will initiate a review of the constitutionality of the Law on Internal Affairs, EA MP Nikola Zirojevic announced, and called on all opposition colleagues to support this initiative.
He said that the EA believes that the newly adopted provisions of the Law on Internal Affairs are unconstitutional on several grounds, and that their implementation could lead to irreparable harmful consequences.
Zirojevic argues that, by introducing the legal possibility of not providing an employee with the explanation on the basis of which a security disturbance in their work was determined, the constitutional right to defense is directly violated.
Such a decision, he said, violates, among other things, the article of the Constitution that refers to the presumption of innocence.
Zirojevic also pointed out that the law introduces retroactive application, because “security disturbances” will be interpreted on the basis of data on each officer individually, in connection with events that occurred before the law entered into force.
Zirojevic warned that, on the basis of such a proposal, it is indisputable that every court proceeding will end with a decision annulling the termination of employment and ordering the officer’s reinstatement with compensation.
“This means that the police will not get rid of controversial and corrupt police officers (who should be legally acquitted, through proper legal proceedings), but such officers will also be returned to work with this bizarre legal solution and will use the court verdict as “proof” of their innocence”, Zirojevic argues.
