Supreme court rejects state prosecutor’s request for protection of legality in Telekom case

Podgorica, (MINA-BUSINESS) – The Supreme Court rejected as inadmissible the request for protection of legality filed by the Supreme State Prosecutor’s Office (VDT) in the case known as Telekom, which sought a review of the decision of the High Court panel.

 

The case pertains to suspects Milo Djukanovic, Ana Djukanovic, Veselin Barovic, Oleg Obradovic, Damjan Hosta, and Tomas Marvai.

 

“The Court took a clear position that, in this specific case, criminal proceedings had formally not even begun, which means that the legal conditions for filing a request for protection of legality as an extraordinary legal remedy were not met,” the Supreme Court said in a press release.

 

The explanation states that the decision of the High Court panel does not constitute a final decision on criminal liability, but rather a procedural ruling enabling certain evidentiary actions and returning the case to the investigative judge for reconsideration.

 

The Supreme Court explained that a request for protection of legality is not a means of reopening proceedings or a “third instance of trial,” but an extraordinary legal remedy that may be used exclusively against final court decisions.
