President’s Office seeks legal analysis of settlement in Sveti Stefan case

Podgorica, (MINA-BUSINESS) – The Office of Montenegrin President Jakov Milatovic has requested from the Protector of State Property and Legal Interests, Bojana Cirovic, a detailed legal analysis regarding the conclusion of a settlement in the arbitration proceedings related to Sveti Stefan, as well as answers to questions relevant to the protection of national interests.

 

“We are addressing you regarding the Government’s decision to proceed with concluding a settlement in the arbitration proceedings concerning the Sveti Stefan tourist complex, taking into account the entire course of the case, previously adopted legal positions of the state, and the potential consequences such a decision may have on Montenegro’s property interests,” the President’s Office stated in the letter.

 

They recalled that the arbitration proceedings were initiated in 2021, following the closure of the Sveti Stefan complex due to a dispute over the use of the beaches.

 

“During the proceedings, the Government, with the active participation of the institution you lead, pursued a clear legal strategy: contesting state liability and presenting counterclaims against the investor Adriatic Properties,” the Office said.

 

They added that, despite this continuity and clearly defined legal strategy, the Government opted to conclude a settlement which, according to publicly available information, effectively implies abandoning further challenges to the legal framework under which the dispute was conducted.
