Political pressure cannot replace the Constitution and the law

Podgorica, (MINA-BUSINESS) – A well-ordered legal system is not based on political will, but on the consistent application of the Constitution, the Employers’ Federation stated in response to remarks about Sunday trading restrictions, adding that attempts to relativize the role of social partners by comparing it to the political legitimacy of elected representatives are a cause for concern.
The Montenegrin Employers’ Federation (UPCG) reacted to frequent statements regarding work-free Sundays and the effects of current legal provisions, particularly claims made by MP Milos Pizurica that, in relation to the Federation’s initiative to assess constitutionality, its representativeness and legitimacy should be reconsidered.
“The Employers’ Federation points to an extremely inconsistent, selective, and politically conditioned approach to facts in the public discourse on an issue that has direct and long-term consequences for the economy and the labour market,” the Federation said in a press release.
At the same time, they consider it problematic to challenge the right to use legally prescribed mechanisms, including the initiative for constitutional review.
Such an approach goes beyond disagreement over public policies and enters a space that calls into question the fundamental principles of the rule of law and institutional balance in a democratic system, which they find unacceptable.
