Parliament readopts amendments to Constitutional Court Law

 

Podgorica, (MINA) – The Parliament of Montenegro readopted on Tuesday the amendments to the Law Constitutional Court, after President of the Republic, Jakov Milatovic, returned it to the Parliament for reconsideration.

 

41 MPs voted in favor of the amendments, 15 were against, while there was no abstentions.

 

Parliament Speaker Andrija Mandic said that anyone who wants to pursue an additional legal remedy can turn to the Constitutional Court in order to determine whether the law violates the Constitution or not.

 

The Article 3 of the Law stipulates that a judge of the Constitutional Court, whose term has ended due to meeting the conditions for old-age retirement or the expiration of their term of office, can continue to perform the duties until the election of a new judge.

 

Milatovic had previously said that this provision is disputed from the point of view of compliance with Amendment 16 paragraph 2 of the Constitution of Montenegro and that with it the legislator completely deconstitutionalizes the cited constitutional norm and derogates the Article 145 of the Constitution, according to which every law must be in accordance with the Constitution.
