Kadic unlawfully dismissed as FZO director

Podgorica, (MINA) - The Administrative Court has annulled the decision of the Board of Directors of the Health Insurance Fund (FZO) to dismiss Vuk Kadic from the position of FZO director, which had been justified by the claims that he acted contrary to the Law on Mandatory Health Insurance and exceeded his authority.
The Administrative Court announced that its verdict upheld Kadic’s appeal and revoked the decision of the FZO Board.
The Administrative Court, as stated, assessed that the defendant’s conclusion that the provisions of the Law on Civil Servants and State Employees do not apply to the dismissal of the FZO director is unclear and insufficiently explained, especially considering that the law also regulates the grounds for dismissing appointed officials, as well as disciplinary liability for serious violations of official duties.
“As it was established that the reasoning of the decision does not meet legal standards and that there were procedural violations that could have affected the legality of the decision, the court annulled it and sent the case back to the defendant body for reconsideration”, the press release concludes.
