Podgorica, (MINA-BUSINESS) – According to the Social Justice Action (ASP), the parliamentary Inquiry Committee for Mozura should also consider recommending contract termination under the United Nations (UN) Convention.
“The parliamentary Inquiry Committee for the Mozura, i.e. the case that is under serious suspicion of being a high-level corruption scheme, should also consider the provisions of the UN Convention against Corruption, which allows corruption to serve as grounds for contract termination or withdrawal of a concession, and include appropriate recommendations on this aspect in its final report,” ASP stated.
The Inquiry Committee began presenting data and information on the Mozura case this week, an issue that investigative journalists and interested parties have been reporting on for years, backed by substantial evidence.
“It appears that this evidence never ‘reached’ the address it should have – the Special State Prosecutor’s Office – as the public is still unaware whether the case has been closed or remains open, ‘collecting dust’ in prosecutors’ drawers while awaiting the statute of limitations,” ASP said.
The NGO also recalled what the UN Convention stipulates.
“With due regard to the rights of third parties acquired in good faith, each State Party shall take measures, in accordance with the fundamental principles of its domestic law, to address consequences of corruption. In this context, States Parties may consider corruption a relevant factor in legal proceedings to annul or rescind a contract, withdraw a concession or other similar instrument or take any other remedial action,” the Convention says.
