HRA: Constitutional Court judges should be elected urgently

 

Podgorica, (MINA) – The Constitutional Court can only function fully effectively if it operates in its full composition, the Action for Human Rights (HRA) said and called on the Parliament to include the election of new judges on the agenda without delay.

According to HRA, the fact that the Constitutional Court is not filled, having six of the seven envisaged judicial positions filled, has prevented it from making an important decision on reviewing the constitutionality of the law confirming the agreement between Montenegro and the United Arab Emirates.

“Furthermore, Desanka Lopicic is illegitimate among those six judges, since her position should have been terminated as she met both retirement requirements”, HRA stated.

According to the press release, the Parliament should urgently elect both candidates for Constitutional Court judges – Podgorica High Court judge Predrag Krstonijevic and Supreme Court judge Jelena Ruzicic, put forward by the President of the State, Jakov Milatovic.

“In relation to those candidates, no member of parliament has publicly expressed any objection, nor are we aware of any reason why they should not be elected to those positions”, says the HRA.
