Government adopts draft amendments to Constitutional Court Law

Podgorica, (MINA) – The Government of Montenegro has adopted draft amendments to the Law on the Constitutional Court, aimed at ensuring uninterrupted functioning of that court, by allowing judges to continue performing their duties until the new judges take up duty.
The Government stated that the amendments were prepared to clarify certain legal solutions, concerning the procedure for early termination of the mandates of judges and presidents of the Constitutional Court due to meeting the conditions for old-age retirement, in line with the recommendations of the Venice Commission.
“In this way, the regular functioning of the Constitutional Court will be enabled by adopting a provision that would allow judges to continue performing their duties until new judges take office, in order to avoid situations in which positions remain vacant due to delays in appointments of new judges”, the statement issued after the Government session said.
